2019

On June 26, 2019, the Texas Court of Criminal Appeals adopted the district court's findings and conclusions denying Reed's eighth state post-conviction writ.  The TCCA also dismissed Reed's remaining claims in his eighth state post-conviction writ and dismissed the ninth state post-conviction writ.

On July 12, 2019, the state requested that the district court set an execution date.  The request was granted on July 26, 2019 and Reed's execution was scheduled for November 20, 2019.  Reed's attorneys sought withdrawal of the order, alleging that it was requested as retaliation for public protests staged by Reed's family's public at the U.S. Supreme Court.

On September 24, 2019, Reed filed a writ of certiorari at the U.S. Supreme Court, seeking review of the denial/dismissal of the claims in his eighth and ninth state post-conviction writs.  The state's brief in opposition was filed on October 28, 2019.  The writ was set for conference on November 15, 2019 and was relisted for December 9 and December 16.  It has been relisted for conference on January 10, 2020.

On November 12, 2019, Reed filed his tenth state post-conviction writ, alleging new Brady and false testimony claims arising from new witnesses who claimed to have witnessed various inculpatory statements by Jimmy Fennell.  Three of these witnesses were law enforcement officers.

On November 15, 2019, the TCCA ordered that Reed's execution be stayed and remanded four of the clams in his tenth writ to the trial court.  Reed's counsel is currently challenging the appointment of Judge J.D. Langley and seeking that hearings be held by Bastrop County Judge Carson Campbell.
